Acceptable Use Policy

1. Who this policy applies to

This Acceptable Use Policy applies to everyone who uses BrandGen, the brand-aligned AI image generator operated by Apex Thirty6Technology Services LLP ("we", "us"). It covers everything you upload, type, generate, edit, download, or share with BrandGen, including prompts, reference images, logos, brand guidelines, website imports, comments, and public share links.

It forms part of our Terms of Service. If you break this policy, we may remove content, block generations, disable share links, or suspend or close your account.

2. What BrandGen is for

BrandGen is built for business and marketing visuals: social posts, ads, banners, product shots, posters, packaging, and similar on-brand images for brands you own or are authorised to work on.

3. Sexual and NSFW content is not allowed

You may not use BrandGen to create, request, edit, or share sexual, explicit, pornographic, or NSFW content of any kind. This includes nudity or partial nudity, sexual acts, sexualised poses or framing, fetish content, lingerie or swimwear imagery that is sexualised or suggestive, and any image intended to be sexually suggestive or provocative.

This applies to every model, every plan, and every feature, including prompts, reference images, and edits of an existing image.

Content that sexualises minors, or anyone who appears to be a minor, is strictly prohibited. We report it to the relevant authorities.

4. No deepfakes, face-swaps, or impersonation

You may not use BrandGen to create deepfakes, swap or replace faces, manipulate a real person's face or body, or produce images that show a real, identifiable person doing or saying something they did not do or say.

You may not upload a photo of another person, or create an image of a real, identifiable person, without that person's consent. You may not impersonate any person, brand, or organisation, or present an image as an endorsement by someone who has not given it.

• Images made with BrandGen contain metadata that identifies them as AI-generated. You must not remove, alter or hide that metadata or any label.
• Where the law requires it, including India's Information Technology Rules, you must clearly disclose that an image is AI-generated when you publish or share it, especially if it shows a realistic person or event.

5. Use only brands you own or are authorised to use

Only upload logos, brand guidelines, product photos, websites, and other brand material that you own or that the brand owner has authorised you to use. Do not use BrandGen to create counterfeit products, fake advertising for brands you do not represent, or material that infringes anyone's trademark, copyright, or other rights.

You are responsible for checking that you have the rights you need before you publish or sell an image you made with BrandGen.

6. Other prohibited content

You may not use BrandGen to create or share content that:

• is illegal, or promotes or facilitates illegal activity;
• depicts or promotes violence, terrorism, self-harm, or graphic gore;
• harasses, threatens, bullies, or promotes hatred or discrimination against people based on protected characteristics;
• is designed to deceive, such as fake documents, fake IDs, fake receipts, scams, phishing, or political or election disinformation;
• promotes weapons, illegal drugs, gambling, or other regulated goods in breach of the law where it is published;
• violates anyone's privacy, including images of private individuals without consent or personal information about others.

7. Misuse of the service

You may not try to bypass our safety filters, moderation, rate limits, or credit system, for example by rewording a blocked prompt to get the same result, splitting a prohibited request across several prompts, or hiding instructions in reference images. You may not scrape, reverse engineer, or resell BrandGen without our written permission.

8. How we enforce this policy

Prompts and uploaded images are screened before any image is generated, and anything that breaks this policy is refused. Our AI model providers also run their own safety checks, and generations they flag are blocked and not delivered.

We may review content that is reported to us or flagged by our systems. If you break this policy we may, depending on how serious it is: refuse the request, remove the content, revoke public share links, limit your usage, suspend your account, or close your account without a refund of unused credits or subscription fees, to the extent the law allows.

If our safety checks block a request before it runs, no credits are used. If a request is blocked after credits were reserved, those credits are returned automatically.

We cooperate with law enforcement where the law requires it.

9. Reporting content

If you see BrandGen content that breaks this policy, including on a public share link, email hello@getbrandgen.com with the link and a short description. We acknowledge reports within 24 hours and resolve them within 7 days; reports of nudity, sexual content, morphed images or impersonation of a real person are acted on within 2 hours.

If you believe content made with BrandGen uses your likeness, your brand, or your work without permission, email the same address with the link, what you own, and how to reach you. We will review it and remove the content if it breaks this policy.

10. Changes

We may update this policy. The "Last updated" date at the top of this page shows the latest version. Continued use of BrandGen after a change means you accept the updated policy.
