1. Acceptance of Terms

By accessing or using BrandGen ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms apply to all visitors, users, and others who access or use the Service. By continuing, you represent that you are at least 18 years old or have the legal capacity to enter into this agreement.

2. Description of Service

BrandGen is a brand-aligned AI image generation tool. You supply brand context (uploaded images, URL, or text guidelines) and a prompt; the Service returns AI-generated images aligned to your brand's visual identity.

Features, pricing, model availability, credit rules, and output behavior may change over time. Current plan details are shown on the Pricing page and in the app.

3. Your Account

You must sign in through a supported authentication provider to use the Service. You are responsible for maintaining the confidentiality of your account and for all activities that occur under it.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in abuse, or represent a material risk to the Service or other users.

4. User Content and IP

You retain ownership of brand assets, prompts, guidelines, and other content you upload or provide to BrandGen.

By providing content, you grant BrandGen a limited licence to host, process, display, and use that content as needed to operate the Service, generate outputs, provide support, enforce these Terms, and honor your sharing settings.

We do not claim ownership of your inputs or generated outputs. You are responsible for reviewing outputs and ensuring you have the rights needed for your intended use.

If you create a public share link or enable a public creator byline, you are choosing to make that shared image and the selected public profile information visible to anyone with the link.

5. Acceptable Use

You may not use BrandGen to generate or share content that is illegal, defamatory, harassing, abusive, deceptive, sexually exploitative, or infringing.

You may not upload content you do not have the right to use, impersonate others, misrepresent outputs as endorsed by a third party, or use BrandGen to violate another person's privacy or intellectual property rights.

You may not reverse engineer the Service, attempt to extract model weights or system prompts, bypass rate limits or credit systems, resell access without permission, or use automated scraping or abuse patterns that harm the Service.

We may remove content, disable share links, limit usage, or suspend accounts that violate these rules or create risk for BrandGen, other users, or the public.

6. Credits and Billing

BrandGen may use credits, usage limits, plan allowances, subscriptions, and optional credit pack purchases. Current plan details are shown on the Pricing page and in the app.

Paid checkout and payment details are handled by a payment processor. BrandGen does not store full card numbers or payment credentials.

Credits are account-based and non-transferable. Promotional, included, or purchased credits may be subject to plan rules shown at checkout or in the app.

Refunds, cancellations, renewals, failed payments, and access changes are handled according to the checkout terms shown to you and applicable law.

7. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind to the fullest extent permitted by law.

We do not warrant that BrandGen will be uninterrupted, error-free, secure, or produce results that meet your requirements.

AI-generated images may occasionally produce unexpected results. You are responsible for reviewing outputs before use.

8. Limitation of Liability

To the maximum extent permitted by law, BrandGen will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of the Service.

To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the amount you paid BrandGen in the 12 months before the claim.

9. Changes to Terms

We may update these Terms at any time. We will notify you of material changes by email or an in-app notice. Continued use of the Service after changes become effective constitutes acceptance.
